    Access to and use of this Website, buying products via the Website, and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service" or "Terms").  Please read these Terms of Service carefully before using the Services.  By using the Services, you are agreeing to all of the Terms of Service, including those additional terms and conditions and policies referenced herein and/or available by hyperlink.  If you do not agree to all the terms and conditions set forth in this document, do not access the Services. 
    Any new features or tools which are added to the current store shall also be subject to the Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes on our Website. These Terms may be updated from time to time, and you are responsible for checking this page regularly to take notice of any such changes. Your continued use of or access to the Services following the posting of any changes shall indicate acceptance of such changes.
    Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services and/or Website without notice. We will not be liable if, for any reason, the Services are unavailable at any time or for any period. Please note that from time to time, we may restrict access to parts or all of the Services.

    You may not use Services for any illegal or unauthorized purpose, nor may you, via the use of the Services, violate any laws in your jurisdiction, including, without limitation copyright laws. A breach or violation of any of the Terms will result in an immediate termination of the Services.
    You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, viruses, codes of a destructive nature or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through the Services and/or Website. Breaching this provision would constitute a criminal offense and Stone Stream will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

     

  4. Intellectual Property, Software and Content

    All the Intellectual Property Rights (as defined below) evidenced by or embodied in and/or attached/connected/related to the Services, including without limitation any underlying software, platforms, technology, application and website design, any information, services, texts, files, sound, music, videos, various applications, social graphs, organization, structure, specifications, application "look and feel", features and related content that may be created in connection with the use of or registration to the Services,  any modifications, enhancements, derivatives thereof and all Intellectual Property Rights related thereto are the property of Stone Stream and/or its respective affiliates and/or, advertisers and other licensors which retain all right, title and interest in connection therewith.
    Other than as set forth herein no transfer or grant of any rights is made or is to be implied by any provision of these Terms or by any other provision contained in the Services with respect to the Stone Stream Intellectual Property Rights or otherwise.
    "Intellectual Property Rights" means worldwide (a) rights associated with works of authorship, designs and photography including copyrights; (b) trademarks, service marks, domain names, logos, trade names, trade dress and goodwill rights whether or not registered; (c) rights analogous to those set forth herein and any other proprietary rights relating to intangible property; (d) divisions, continuations, renewals, reissues and extensions of the foregoing (as applicable) now existing or hereafter filed, issued, or acquired.
    You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears via the Services, nor may you use any such content in connection with any business or commercial enterprise.
     

  5. Terms of Sale

    By placing an order you are offering to purchase a product on and subject to the following terms and conditions.  By agreeing to these Terms of Service and/or making a purchase from the Services, you represent that you are over 18 years of age, or at least the age of majority in your state, country or province of residence. 
    All orders are subject to availability and confirmation of the order price. Although we will do our best to expedite dispatch, we are not responsible for delayed dispatch times, as dispatch may vary according to availability, supply center location )countries may vary) and customer shipping address, peak seasons including holidays, among other factors, nor will we be responsible for any delays resulting from postal delays or force majeure. Please note that the above extends to all orders, even when you have selected and paid for an alternate or expedited shipping method. 
    Please be aware that we are not responsible for delays or lack of delivery due to errors in the order details provided by the user, such as a wrong address or zip code, however and without taking responsibility for such errors or delays, we will extend our best efforts to notify you and reroute the package. 
    Damage to the product may occur during delivery, and we are not responsible for such damage. However, we may decide to provide you with a proper resolution, on a case-by-case basis, at our sole discretion. To that end, we may ask you to prove the damage to the product by sending us pictures or videos. Such a process may extend the delivery time. 
    In order to contract with StoneStream you must use a valid and verified payment method acceptable to us, and we reserve the right to change which payment methods we accept without notice. Stone Stream retains the right to refuse any payment option or request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. Fulfillment of an order might be provided by us through a third party contractor with which we may or may not have a direct relationship. Where a contract is made with a third party, Stone Stream is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. 

    (a) Placing Orders 

    When you place an order, you should receive a confirmation by e-mail that the goods which you ordered have been dispatched to you.  If you do not receive a confirmation e-mail for any reason, you should contact us at https://www.stone-stream.com/contact to verify that the order has be placed and dispatch confirmed. Further if for any reason you do not receive good by the estimated delivery time, you should contact us at the address above to inform us of such delay, and allow us the opportunity to contact the delivery service.

    (b) Pricing and Availability

    While we try and ensure that all details, descriptions and prices which appear via the Services are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as canceled. If your order is canceled and you have already paid for the goods, you will receive a full refund.
    Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the total cost.
    The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes. We reserve the right at any time to modify or discontinue the Services (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

    (c) Payment 

    Upon receiving your order we carry out a standard authorization check on your payment method to ensure there are sufficient funds to fulfill the transaction. Once your payment method is confirmed or debited, we will start processing your order.  The monies received upon the confirmation or debiting of your payment method shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been dispatched the monies paid as a deposit shall be used as consideration for the value of goods you have purchased.   Please note that the delivery time frame starts only from when the payment method confirmation is received by us.
    Taxes and customs expenses are the sole responsibility of the user. 
    We may or may not include invoices inside the packages detailing the pricing of the products purchased. In the event that pricing appears in the package or on the products that is different from what you paid, such as the pricing of the manufacturing, the customer should disregard such pricing and is not entitled to any price adjustments. 

    (d) Accuracy of Billing and Account Information

    When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the payment method used to place your order and that there are sufficient funds to cover the cost of the goods. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

    (e) Returns

    Stone Stream will do it's best to ensure you are happy with your purchase.  If you wish to return a purchased product, you may contact us at https://www.stone-stream.com/contact to coordinate the return.  Stone Stream will do its utmost to reply to return inquiries in a timely manner, however, during peak times, there may be delays.
    Stone Stream will evaluate each return request on a case-by-case basis. Refunds will be granted according to return criteria determined by the Website, which may change from time to time. If the aforementioned criteria are not met, Stone Stream may not grant full or partial refunds. Stone Stream does not cover the shipping costs for returned products. 
    If a product or good ordered gets lost in transit, Stone Stream reserves the right to (a) send a replacement order or (b) refund you, depending on the availability of the product or (c) resolve the matter in any other manner Stone Stream sees fit.  Please note that if a return request is accepted, we do not commit to paying for the return shipping of such a product. 
     

  6. Linking to the Website and Third-Party Content

    You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.
    Certain content, products, and services available via our Service may include materials from third-parties. We also have social media pages. We invite you to visit such pages and ask that you use them to support our Services and products.
    Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
    We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
     

  7. Variations

    Stone Stream shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.
     

  8. Inaccuracies and Omissions

    Occasionally there may be information provided via the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
    We do not undertake any obligation to update, change or clarify information in the Services or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.
     

  9. Invalidity

    If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
     

  10. Comments and Complaints

    We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.
    If you have a complaint, dispute or refund to raise with one of our suppliers or payment processors, dispute or chargeback please contact Stone Stream directly, and we will extend our best efforts to resolve such an issue for you in a timely manner. However if you contact or raise a dispute directly with the payment processors, products’ suppliers or manufacturers  this will immediately terminate any contract or relationship between you, the user, and us, in which case we may or may not continue to communicate with you to resolve the issue.
     

  11. Disclaimer of Warranties and Limitation of Liability

    Stone Stream does not guarantee or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
    The material displayed via the Services is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law. We provide no warranty that the results, goods or products that may be obtained from the use of the Services will be accurate, reliable, or appear or function as described or advertised. 
    You expressly agree that your use of, or inability to use, the Services is at your own risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. 
    In no case shall Stone Stream’s directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, bodily harm, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, potential harm products sold through the Services may have on other dependent or integrated product, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.  Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

    You agree to indemnify, defend and hold harmless Stone Stream, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of the Services or your breach of the Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of any third-party.
     

  13. Waiver

    If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
     

  14. Severability

    If the Terms of Service is determined to be unlawful or unenforceable, the Terms shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any of the remaining provisions.

    These Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Stone Stream. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by an authorized signatory of Stone Stream. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

    These Terms of Service and any linked agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales.

  • By consenting to Excite Foundry Inc's SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list.

  • Message frequency varies. Consent is not a condition of purchase. If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages.

    To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
